The SEC Opened On-Chain Stocks With a 0.25% Cap, 2026

The SEC issued an order on September 17, 2026 that lets tokenized versions of US listed stocks trade on chain, outside the exchange rules that have run stock trading since 2005. The pitch you're going to hear is 24/7 markets and a wall of crypto money finally flowing into US stocks. The order is a lot narrower than the pitch. Each venue is capped at 75 of the big names and 0.25% of a stock's daily volume, so this is a real change to market plumbing and not the liquidity flood it's being sold as.

What the Data Shows

The SEC calls it the innovation exemption. It exempts a tokenized securities venue from the definition of an exchange, and the liquidity providers in its pools from the definition of a dealer, running September 17, 2026 through September 17, 2031. Because the venue isn't an exchange, the Regulation NMS rules that apply to exchanges don't apply to it, including Rule 611, the 2005 trade through rule that forces your order to the best displayed price. Prices on these venues come from the ratio of assets sitting in an automated market maker pool, not from the national best bid and offer.

Then come the limits, and they're specific. A venue can trade at most 75 Tier 1 symbols, meaning S&P 500 and Russell 1000 names plus eligible ETPs, and at most 250 Tier 2 symbols. Its daily volume in any single Tier 1 stock is capped at 0.25% of that stock's average daily share volume from the prior month, and 2.5% for Tier 2. Affiliated venues have to add their symbol counts together, so nobody can spin up 5 shells and multiply the cap.

Daily closes of S&P 500 futures from August 24 to September 24, 2026, with the failed CLARITY Act cloture vote and the SEC innovation exemption marked.

Size and timing both matter here. Tokenized equities were about $4.43 billion on chain as of September 15, 2026 per Binance Research, up 390.4% year to date, and that's the entire category worldwide. The Senate's cloture vote on the CLARITY Act failed 50 to 49 on September 15, 2026, short of the 60 votes it needed, and the SEC order landed 2 days later. Congress didn't write the crypto market structure law, so the regulator wrote a 5 year test window instead.

Why It Matters for Your Portfolio

The direct read through is the brokers, and $HOOD is the name everybody reached for. A venue with no best price requirement means wider spreads, and wider spreads are a much better business for whoever handles the order than the penny wide spreads brokers live on in equities today. I think that bull case is real, but it's a 2027 revenue story at the earliest since a venue has to publish notice 30 days before it can even operate. For the index itself, those volume caps mean this adds nothing meaningful to S&P 500 buying in any timeframe that matters to your portfolio this quarter.

What I'm Watching

Two things. First, which venue actually posts its 30 day notice, and whether listed companies start objecting, because an issuer that gets notice can block a third party version of its own stock in writing and the venue has to stop. Second, the comment file on the June 11, 2026 proposal to rescind Rule 611 for all stocks, not just tokenized ones.

The second one is the bigger deal by a wide margin. If the trade through rule goes away market wide, the routing every retail order has lived under since 2005 changes for everybody, and the tokenized carve out was just the pilot. I'd watch the comment file more closely than I'd watch any ticker.
